    By Submitting this form, you are agreeing to the terms and conditions below.

    • The Applicant states to A Star Forensics that they are the owner of, and/or has the legal right to be in possession of, all equipment/data/media given to A Star Forensics; and the Applicant will defend, at its expense, indemnify, and hold A Star Forensics harmless against any damages or expenses that may occur (including reasonable legal fees as determined by a court of competent jurisdiction), and pay any such determined cost, damages, or fees awarded against A Star Forensics resulting from the Applicant’s breach of this section.
    • The Applicant has advised A Star Forensics it has been unable to access, view and/or recover certain data, which the Applicant represents to be its property, and engages A Star Forensics to use its best efforts to identify said problem (if not already identified), and use its best efforts to retrieve said data or portion thereof and to provide such other services as may be agreed to between the Applicant and A Star Forensics in writing from time to time.
    • The Applicant is aware that should offences be disclosed during the extraction it will be incumbent upon A Star Forensics to inform the relevant authority.
    • The Applicant agrees that the equipment/data/media may be damaged, unusable, or otherwise inaccessible prior to A Star Forensics receipt, and the Applicant further acknowledges that the efforts of A Star Forensics and/or its suppliers to complete this engagement may result in the destruction of, or further damage to, the equipment/data/media. A Star Forensics, for itself and its suppliers, does not assume responsibility for any damages that may occur to the Applicant equipment/data/media during or as a result of A Star Forensics efforts to complete this engagement. A Star Forensics, for itself and its suppliers, makes no warranties or conditions for any good or service, either express, implied, statutory, or arising from any communication with the Applicant. A Star Forensics, for itself and its suppliers, specifically disclaims any implied warranty of merchantability, or fitness for a particular purpose arising from usage of trade in the course of dealing or performance.
    • The total cost of service will be provided only once the device is assessed. The customer will be provided with this Estimate in advance of any chargeable works being carried out.
    • Complaints should be made in writing and addressed to; The Secretary, A STAR FORENSICS LTD, Star House, PO Box 162, Neath, SA11 9BR.
    • The Applicant is aware that A Star Forensics will not retain any recovered data and that all the data will be handed to the Applicant.
    • In no event, will A Star Forensics or its suppliers be liable for any damages whatsoever, including, without limitation, damages for loss of data, loss of business profits, loss of any warranties, business interruption, or other pecuniary loss, or incidental, consequential, or indirect damages arising from this engagement even if A Star Forensics or any authorised representative, has been advised of the possibility of such damages, except if such damages arise from the wilful misconduct, negligence or fraud on the part of A Start Forensics. The Applicant acknowledges that the estimated and actual fees and charges reflect this limitation of liability and allocation of risk. The total liability of A Star Forensics or its suppliers to the Applicant under this agreement shall in no event exceed the total sums paid by the customer to A Star Forensics. Notwithstanding the foregoing, nothing in this Agreement shall operate to exclude or restrict either party's liability for death or personal injury resulting from negligence, or as a result of fraud, for which no limit applies.
    • A Star Forensics will use any Information provided by the Applicant only for the purpose of fulfilling the engagement and will use its best efforts to hold the Applicant's Information in the strictest confidence. To further clarify, each party agrees, for the term of these Terms and Conditions and for two years after its expiration or termination, to hold the other party’s Information in strict confidence, not to disclose such Information to third parties not authorized by the disclosing party to receive such Information, not to release the Information except to employees requiring the Information in the performance of their duties and who are made aware of and who are bound by obligations no less onerous than the confidentiality obligations set out herein, and not to use such Information for any purpose except as expressly permitted hereunder. A Star Forensics may disclose Information to the extent required by law. Confidentiality shall not apply to any information which entered the public domain through no fault of A Star Forensics; which was known to A Star Forensics prior to receipt from the Applicant; which is disclosed to A Star Forensics by a third party (other than employees or agents of either party); which in making such information available to A Star Forensics is not a violation of any confidentiality obligation to the disclosing party; which is independently developed by A Star Forensics without recourse to the Applicant's information; or which is illegal.
    • By submitting equipment/media/data to A Star Forensics, Applicant agrees to be bound by these Terms and Conditions. The Applicant must notify A Star Forensics of any inaccuracies, or changes to this information. 
    • A minimum cost of £75 will be charged if data is recovered but the Applicant no longer requires it.
    • Due to health and safety any device that is opened to gain access to the internal chip will be returned in its destroyed state.
    • Some processes require full payment upfront to cover the cost of data recovery process, the applicant will be full updated about this prior to work commencing.
    • The parties hereto are independent contractors and nothing in these Terms and Conditions shall be construed to make the parties hereto partners, joint venturers, employees or agents of each other, nor shall either party so hold itself out. Neither party shall make any representation or commitments on behalf of the other party.
    • A Star Forensics and Applicant shall each remain solely responsible for the payment of all wages and benefits for each of their own respective employees.
    • Each party represents, warrants and covenants that: (i) it has the full power and authority to execute and deliver these Terms and Conditions; and (ii) the execution, delivery and performance of these Terms and Conditions does not and will not result in the violation of any applicable law or conflict in any material respect with or constitute a material breach under any document, agreement, license or other writing by which it is bound.
    • Neither party shall disclose the terms of these Terms and Conditions, nor use the other party’s name, trade names, trademarks or logos or those of its affiliates in any brochure, advertisement, client list, press release, or other marketing material without the prior written consent of the other party in each instance.
    • These Terms and Conditions may be executed in multiple counterparts, which may be delivered by PDF or other electronic means and each of which when so executed will be deemed to be an original, but all of which together shall constitute one and the same instrument.
